When Dave Sheppard retired in 2020 he kindly gave me permission to publish the contents of his website (originally named after his firm, "Dave Sheppard Associates", then called "MHAandMCA"). Prosecutions, defendants and offences

- 310 prosecutions of 462 defendants (287 women and 170 men (5 unknown))

-Charged with 1, 252 offences under s.127 MHA 1983 or s.44, MCA 2005

- 837 (67%) of ill-treatment and 422 wilful neglect (33%)

- 25 defendants were also prosecuted at the same time for 64 other offences (assault, fraud, wrong administration of medication etc)

- Defendants were aged between 18 - 69

- Since 2007, there have been 8 prosecutions (31 defendants of which 9 were acquitted) charged with 136 offences under s.127, MHA 1983 (Alma Court Residential centre; Solar Centre; Winterbourne View; St Georges Hospital; Newsham House; Mountleigh; Hunters Moon; Abbeycroft; Liudas Poderis)

Vast majority of defendants were dealt with by the Crown Court (366) rather than the Magistrates Court (56)

CPS dropped charges against 38 defendants during the court process

102 defendants were acquitted by the Court

No cases were specifically sentenced as hate crimes (s.146, Criminal Justice Act 2003) although in both Winterbourne View and the Solar Centre prosecutions this was raised by CPS

These offences are not referable to the Attorney General under the unduly lenient scheme.

In addition to the offences above, we have some limited information on the use of police cautioning. This has been a result of either court reporting where there has been a reference to 6 other people being previously cautioned or 5 references to police cautions in disciplinary proceedings before the Nursing and Midwifery Council.

Sentenced

There are no sentencing guidelines so sentences may be inconsistent

287 (59%) defendants were convicted of 746 (54%) offences (517 of ill-treatment and 205 of wilful neglect and 45 charges were for other offences ie assault, wrongly administering medication)

160 pleaded guilty

219 received sentences of imprisonment (including 99 suspended).

Since 2007 the maximum sentence of imprisonment is 5 years

The longest terms of imprisonment were for William Bowman (3 and a half years), Chevonne Benson (3 years); James Hinds and Susan Murphy (33 months each); Wayne Rogers (2 years), Tanzeela Safdar (21 months), and Ann Leach (21 months)

She was not turned in the night despite it being in her care plan because she had bed sores. And she was not allowed to use the toilet and left in a wet incontinence pad. Another resident who was refused help despite repeatedly asking to go to the toilet - and then being verbally abused when he soiled himself.

16/4/2018	Shaunna Hughes (26)	Chelmsford Crown	CLEARED	Accused of throwing a marker pen at a resident who was sleeping and shouting at him to wake up. The pair also started a water fight, they were out in the garden and It was in the house, they went into one of the resident's rooms with the hose. They went and had a shower and came out with one of the resident's clothes on.
4/4/2018	James Gale (44)	Carlisle Crown	22 months suspended for 2 years. 30-day rehabilitation programme and 140 hours of unpaid work	"forced" apart the woman's legs to change her incontinence pad, causing her hip to crack as she cried out in pain. Gale was also seen verbally abusing the elderly man and pinning him to the bed
23/3/2018	Fiona Riley (44) Nicola Scott (42)	Swansea Crown	CLEARED	Riley was alleged to have slapped and sworn at the patient while attempting to clean him and then subdue him after he had soiled himself, and later dragged him by the wrists. Scott was alleged to have failed to record the incident in a report log, and was claimed to have told a colleague "you did not see that".
21/3/2018	Wyn Ellis (57) Danny Dias (57)	Horsham Magistrates	12 month community order of 140 hours unpaid work, 15 rehabilitation activity requirement (RAR) days and ordered to pay costs of £620, as well as a victim surcharge of £85 12 month community order of 240 hours unpaid work, ordered to pay costs of £400 and victim surcharge of £85	Was filmed laughing at the patient who was unable to stand as she struggled to free herself. Used a cable to bind the patients feet together and filmed her falling on the floor.

Poking her nose, pushing her head from side to side.

11/10/2017	Michelle Mitchell (53)	South East Northumberland Magistrates'	12-month community order and told to do 100 hours of unpaid work, £710 in costs and a victim surcharge	Punched a resident then dug her fingernails into her own arm and said it was the resident.
27/9/2017	Pedro Dias (21) Piotre Ciecielowski (26)	Chester Crown	9 months in prison, suspended for 2years, ordered to complete 250 hours unpaid work. They must both pay the victim £250 compensation.	They were caught on CCTV verbally abusing the resident 'forcibly and unceremoniously' dumping her onto her bed to clean her, Dias threatened to 'break every bone' in her body, 'kill' her and drag her by the head to her bed he also slapped her across the face her across the face causing her to yelp in pain and calling her a 'dipstick'. Ciecielowski failed to stop Dias or report him and branded the victim a 'silly bitch'.

12/7/2017	Costel Fusaru (45)	Ipswich Crown	CLEARED	Accused of getting angry and bending the alleged victim's hand back, causing her to scream in pain, and then slapping her face twice after she grabbed hold of his apron while he and a colleague were changing her during a night shift.
20/6/2017	Lisa Thomas (42)	Truro Crown	21 months imprisonment	Instructed her staff not to resuscitate an unconscious patient even though there was no DNR letter. She was also convicted of 7 fraud and a count of administering the wrong medication.
15/6/2017	Ramatu Airemen (61)	Luton Crown	4 months' imprisonment, suspended for 12 months, and ordered to carry out 200 hours' unpaid community	Left a male suffering with Alzheimer's on the floor for an hour.
12/6/2017	Mairead Tansley (49)	Wood Green Crown	9 months imprisonmnent	Filled the mans home of whom she was caring for with her own belonings and left him emaciated, dehydrated and delirious.
22/5/2017	Mavis Offei (64)	Basildon Crown	6 month suspended imprisonment for two years, ordered to carry out 300 hours of unpaid work. Also ordered to pay £300 court costs.	Offei placed a resident in a half-Nelson arm lock and rammed her head into a chair during a row about a mobile phone.
22/5/2017	Ruth Blatchford ( 60)	Manchester Magistrates	12 weeks imprisonment	Blatchford ordered the man to get up, in an 'angry way' then pulled the man by his arm. She was then seen kicking the man in the legs a number of times, which caused him bruising. The court heard that the man then stood up and started to scream. Blatchford then moved behind a chair and used it to push it towards his knees and then slapped the man across his face.
11/5/2017	Ashley Page (27)	Bolton Crown	3 months imprisonment, £115 victim surcharge	Pinched a residents nose, when he raised a leg, in objection to taking a shower, Page forcefully pushed his leg down and took his left hand and twisted his thumb backwards. Page swore and threatened to break his thumb while twisting it.
5/5/2017	Janet Ofem (53) Francis Shanique (21)	Harrow Crown	6 months imprisonment	Left a resident alone in a bathroom for a short while. Using a hoist they put her in a bath, she became very distressed and once she was lifted out of the bath it was seen she had been scalded.

22/11/2016	Maurice Campbell (56)	Peterborough Crown	28 months imprisonment	Was caught on CCTV over a period of 6 weeks verbally abusing the elderly woman, trying to ram tablets down her throat, twisting her fingers and wrists, applying weight to Mrs Melton's stomach in order for her to drink. Campbell can be seen in one clip holding Mrs Melton's arms down and in another said 'you are being a silly person now pack it in'. He also called Mrs Melton a 'stupid woman' and shouted in her face.

Arrived under the influence of drink, failed to get her medication, didn't prepare any food, and let her become dehydrated as well as makingmade inappropriate comments.

A resident felll on the floor, she had broken her hip and arm. The incident was not reported and the carer's lifted her off the floor instead of using a hoist.

25/7/2016	Nicholas Howard (44)	Wolverhampton Crown	7 months imprisonment	Sprayed deodorant over a man with severe learning difficulties, leaving him looking as though he had been dipped in flour he also pulled the male's ears leaving bruising.
18/7/2016	Gary Walker (31)	Cannock Magistrates	4 months imprisonment; £80 victim surcharge and has been banned from caring for vulnerable people again	Sprayed water into a woman's face so she would move as he showered her also threw a wet flannel into a man's face and made him 'writhe' as he pressed it against him. He also admitted turning off a pressure mat in the man's room three times. The mat was there to alert staff if the resident got out of bed because he was at high risk of falling.

30/6/2016	Simon Kahwema (36)	North Staffordshire Justice Centre	Was ordered to pay £650 costs, a £60 victim surcharge. He was also handed a 12 month community order and must carry out 150 hours unpaid work.	Yanked a resident out of bed whilst still asleep leaving bruises on the residents arm.
24/6/2016	Muhammed Azeem (40) Khalid Hussain (29)	Minshull Street Crown	Both men were given 6 months imprisonment suspended for 12 months, made to pay £100 victim surcharge and £250 costs, and given 150 hours of unpaid work.	Washed a resident in cold water, left him to struggle to get up, left him in distress over tissue put on his lip (after being cut from his shave) and was handled roughly.

The married couple tied up an 88 year old resident who suffered from dementia with towels on to her chair for a quiet shift.
18/5/2016	Sarah Gaskin (38)	Maidstone Crown	9 Months imprisonment	Broke a women's collar bone by being rough and was then verbally abusive and abrupt. She was also rough with 2 other residents.

27/4/2016	Alexsander Machhnicki (51)	Exeter Crown nbsp;	150 hours unpaid community work and pay £750 costs	Slapped the resident around the back of the head and pushed her into her chair.
26/4/2016	Tracy Priestley (41) Danielle Snowden (25) Sophie Hinchsliff (24)	Hull Crown	12 month community order, ordered to complete 240 hours, she was also given a 3 month curfew order. Banned from ever being a carer again. Same as Priestley with 200 hours of unpaid work and told to pay £1,500 in compensation to Mrs Jobson. Hinchsliff was given the same as Snowden.	Residents daughter used a hidden camera. Mrs Jobson was asked by the carers if she was a witch who performed "black magic". Her dementia-induced groans were mimicked, and a padded bandage used to cover a bedsore on her elbow was also removed and placed on her head.
20/4/2016	Debra Bott (54)	Warwick Crown	6 months imprisonment - suspended for 2 years; ordered to do 250 hours of unpaid work and pay £500 costs IMPRISONED FOR 3MONTHS ON 25/10/2016 FOR NOT COMPLING WITH THE UNPAID WORK	Bott sent a handyman into the residents room to pretend he was a policeman and scare her. The elderly resident had a curved spine and Bott would grab her chin and pull her head up at meal times. She was also seen on several occasions pushing the old lady's chair in, trapping her fingers between it and the table.

Feb 2016	Daniella Boahemaa-Afrite (20)	Swindon Crown APPEALED 7/12/2016	60 hours of unpaid work and pay a total of £200 in costs for the two hearings and an £80 victim surcharge. WAS UNSUCCESSFUL ON APPEAL	Left marks around the residents neck after dragging him around on the floor by the neck of his T-shirt.

Williams went over the following morning over 12 hours late to find the old man was gone.

She was jailed for 12 months. Sookalingum Appoo, 59, admitted 3 charges of wilful neglect. He was jailed for six months. Kelvin Fore, 33, pleaded guilty to 1 charge of wilful neglect. He was jailed for six months. Michael Ezenagu, 29, pleaded guilty to 2 counts of ill-treatment. His six-month jail term was suspended for two years. Ezenagu was ordered to carry out 200 hours of unpaid work. Neil Ferguson, 28, pleaded guilty to 1 count of ill-treatment. His six-month jail term was suspended for two years. Ferguson was ordered to carry out 200 hours of unpaid work. Jason Gardiner, 43, admitted 2 charges of ill-treatment. His four-month jail term was suspended for two years. Gardiner was ordered to carry out 200 hours of unpaid work. Danny Brake, 27, pleaded guilty to 2 charges of ill-treatment. His four-month jail term was suspended for two years. Brake was ordered to carry out 200 hours of unpaid work. Charlotte Cotterell, 22, pleaded guilty to 1 charge of ill-treatment. Her four-month jail term was suspended for two years. Cotterell was ordered to carry out 150 hours of unpaid work and complete 12 months supervision.	Six out of 11 care workers who admitted a total of 38 charges of neglect or abuse of patients at a private hospital have been jailed. Five other workers from Winterbourne View near Bristol were given suspended sentences after the acts of abuse were uncovered by BBC Panorama.

The mistreatment was uncovered after the pensioner's family recorded the abuse on a camera concealed within an alarm clock at Oakfoss House residential care home. Wallis and Bryan dragged her across her bedroom floor, making the elderly woman scream in pain. Wallis then threatened her with violence.

Thomas Milroy, 85, who had dementia and stayed at Breme Care Home in Bromsgrove, died in January. Checks that should have been carried out on Mr Milroy did not take place. The three workers were charged in relation to the care of Mr Milroy after he had to be taken to hospital after being found lying on the floor of his room. Broadway and Turbill successfully appealed against conviction at the Court of Appeal on 12/7/13

The shocked woman witnessed the assault when she glanced through a window as she passed - and immediately reported it.
26/6/12	Beverley Covell (60)	Mold Crown	Dropped	Covell, who was manager of the Grasmere Nursing Home in Prestatyn, was charged with neglect amid allegations that she asked a member of staff to record an assault upon a resident as an accident. She also denied wilfully neglecting a female resident by letting her leave the Linden Road home. Her trial was due to start yesterday but the prosecution were not ready and when Mr Recorder Huw Rees indicated he would be loath to adjourn the trial, the prosecution offered no evidence.

Also pay £4,000 court costs and £1,500 compensation	Nursing had been convicted of wilful neglect police received a tip-off and went to a house in Woolston. The resident had lived at a home run by Nursing which closed down in 1979 but she continued to live in the property afterwards. Because of her mental condition, the pensioner was unable to manage her financial affairs, which included her pension and housing benefit because she was deemed to be living at the property as a lodger, so Nursing was made an appointee to look after them.

There was no heating, some patients were over-dressed, while others were not dressed properly, their bedding was damp and there was little food in the house. Some also had what appeared to be long-standing scalp and foot infections.

Instead of reporting the incident, a senior nurse told them to lift him back into bed and pretend it never happened, at the home in Weston-super-Mare. Mr Lewis, who was paralysed down one side of his body and had dementia, suffered complications after contracting pneumonia and died 8 days later. Koziel later came forward and confessed to the plot and was given a police caution.

After discussions between 2 burns experts, the CPS offered no evidence of neglect. Mr Adebisi had been accused of leaving the victim in a bath while he went out of the room. But the court heard the valve on the hot water tap was faulty and scalding water burned Mr Green.

1/7/08	Nina Strange	Derby Crown	3 months imprisonment - suspended for 2 years 200 hours' unpaid work and ordered to pay £845 costs	Strange dipped a toothbrush into bath water in which Mrs Walsh, who was incontinent, had defecated, before using it to brush her teeth. The court also heard that Strange had hit an 88-year-old wheelchair-bound woman across the back of the head, twice hit an 81-year-old man on the head and pulled an 81-year-old woman's hair as she put her to bed.

Also a charge of causing actual bodily harm. The jury acquitted her on 4 more charges and she was formally cleared on 2 more after the jurors failed to reach verdicts.

The three men - aged 25, 45, and 56 - have severe learning difficulties, including Down's Syndrome, autism and epilepsy.

He was 42 years old, could become very agitated and anxious in vehicles, had to be put in a harness in vehicles, could not articulate for himself and could not attend to his own personal needs.
