Prosecutions, defendants and offences
- 310 prosecutions of 462 defendants (287 women and 170 men (5 unknown))
-Charged with 1, 252 offences under s.127 MHA 1983 or s.44, MCA 2005
- 837 (67%) of ill-treatment and 422 wilful neglect (33%)
- 25 defendants were also prosecuted at the same time for 64 other offences (assault, fraud, wrong administration of medication etc)
- Defendants were aged between 18 - 69
- Since 2007, there have been 8 prosecutions (31 defendants of which 9 were acquitted) charged with 136 offences under s.127, MHA 1983 (Alma Court Residential centre; Solar Centre; Winterbourne View; St Georges Hospital; Newsham House; Mountleigh; Hunters Moon; Abbeycroft; Liudas Poderis)
Vast majority of defendants were dealt with by the Crown Court (366) rather than the Magistrates Court (56)
CPS dropped charges against 38 defendants during the court process
102 defendants were acquitted by the Court
No cases were specifically sentenced as hate crimes (s.146, Criminal Justice Act 2003) although in both Winterbourne View and the Solar Centre prosecutions this was raised by CPS
These offences are not referable to the Attorney General under the unduly lenient scheme.

In addition to the offences above, we have some limited information on the use of police cautioning. This has been a result of either court reporting where there has been a reference to 6 other people being previously cautioned or 5 references to police cautions in disciplinary proceedings before the Nursing and Midwifery Council.
Sentenced
There are no sentencing guidelines so sentences may be inconsistent
287 (59%) defendants were convicted of 746 (54%) offences (517 of ill-treatment and 205 of wilful neglect and 45 charges were for other offences ie assault, wrongly administering medication)
160 pleaded guilty
219 received sentences of imprisonment (including 99 suspended).
Since 2007 the maximum sentence of imprisonment is 5 years
The longest terms of imprisonment were for William Bowman (3 and a half years), Chevonne Benson (3 years); James Hinds and Susan Murphy (33 months each); Wayne Rogers (2 years), Tanzeela Safdar (21 months), and Ann Leach (21 months)

She was not turned in the night despite it being in her care plan because she had bed sores. And she was not allowed to use the toilet and left in a wet incontinence pad. Another resident who was refused help despite repeatedly asking to go to the toilet - and then being verbally abused when he soiled himself.

Three former care home workers from Worcestershire have been banned from working with vulnerable adults after being found guilty of wilful neglect. Thomas Milroy, 85, who had dementia and stayed at Breme Care Home in Bromsgrove, died in January. Checks that should have been carried out on Mr Milroy did not take place. The three workers were charged in relation to the care of Mr Milroy after he had to be taken to hospital after being found lying on the floor of his room.

Instead of reporting the incident, a senior nurse told them to lift him back into bed and pretend it never happened, at the home in Weston-super-Mare. Mr Lewis, who was paralysed down one side of his body and had dementia, suffered complications after contracting pneumonia and died 8 days later. Koziel later came forward and confessed to the plot and was given a police caution. |
