In response to a FOIA request the MOJ stated that of 2712 conditionally discharged patients there were 39 for whom a database search found the keywords "escorted" or "accompanied" (there were none for "permission"). The true number of Article 5 deprivations of liberty might be lower (the conditions might not reflect current arrangements, and there is no up-to-date information held about capacity) or higher (as wording varies considerably and the care plan might involve deprivation of liberty not reflected in the wording).
