Southern Irish case - transfer of sentenced person The Southern Irish High Court decided that the Transfer of Sentenced Persons Act 1995 applies to a person who for reasons of mental condition has been held not criminally responsible for the commission of an offence. The applicant was therefore eligible for transfer out of the State, and the Minister's refusal was set aside.
