NHS Bodies and Local Authorities Partnership Arrangements (Amendment) Regulations 2009
These Regulations amend the NHS Bodies and Local Authorities Partnership Arrangements Regulations 2000 to include Schedule A1 to the Mental Capacity Act 2005 (the Mental Capacity Act Deprivation of Liberty Safeguards) as a function of NHS Bodies. This will enable primary care trusts to enter into formal partnership arrangements with local authorities.

Official explanatory note
The NHS Bodies and Local Authorities Partnership Arrangements Regulations 2000 (“the Partnership Regulations”) make provision for certain NHS bodies and local authorities to enter into arrangements for the exercise of specified functions.
Regulation 2 of these Regulations amends regulation 5 of the Partnership Regulations to add functions under sections 117 and 130A of the Mental Health Act 1983 and under Schedule A1 of the Mental Capacity Act 2005 to the list of functions that are NHS functions for the purposes of the Partnership Regulations.
