<i>Draft deprivation of liberty safeguards standard forms are being made available now in order to facilitate best practice, training and preparation in advance of April 2009, when the deprivation of liberty safeguards come into effect.
The DoLS project group have been working on new DoLS forms which are now available to download using the links below.  Reducing the forms from 32 to 13 was not an easy task. Some elements of the forms are dictated by regulations and can’t change. Others seem particularly unnecessary. There are some situations still not really covered by a form and these will be addressed in the guidance which will accompany the forms.


The forms can be adapted but, as drafted, they help all those involved in the safeguards processes to fully meet the requirements of the deprivation of liberty safeguards legislation.
The team have added some forms which didn’t previously exist, a “No Deprivation” form in particular. During consultation some people asked why this was necessary. This form has been used in the West Midlands for the last few years and it is very popular with BIA’s and speeds up the process.  There is a new form for a further request for authorisation which is very popular with Managing Authorities. There is also a new form to notify the Coroner of a death.


The first document, published on 29 October 2008, is for supervisory bodies and contains all the forms, developed to date, for both supervisory bodies and for managing authorities.
The forms have had numerous revisions and received a lot of helpful comments from consultation most of which has been incorporated. Some of the comments related more to practice and as such will appear in the guidance to follow.


The second document, published on 14 November 2008, is for managing authorities, and contains only the managing authority forms, with guidance for care homes and hospitals.
We are confident that this revision of the forms will play a small part in speeding up the processing of DoLS authorisations without losing necessary quality.  


Over the coming months, later versions will appear here as the forms reach their final development e.g. the inclusion of templates for supervisory bodies to refer cases to assessors and templates for IMCA reports.

We do not expect there to be any major changes to the content hereafter as the forms already include all the fields required for supervisory bodies and managing authorities to comply with the legislation, but other fields may be included e.g. to facilitate monitoring. We will also be seeking to have the forms produced in a more "professional" format.

These are standard and not statutory forms but supervisory bodies and managing authorities are strongly encouraged to use them as their use will fulfil not only their legal obligations but will bring a nationwide consistency to the implementation of the safeguards.
