DetailText== Official explanatory note == (This note is not part of the Order) Article 2 of, and Schedule 1 to, this Order transfer, modify or abolish certain functions of the Lord Chancellor contained in secondary legislation. In doing so, this Order implements the Concordat agreed between the Lord Chancellor and the Lord Chief Justice in January 2004. The Concordat sets out the principles governing the allocation of functions between the Lord Chancellor and the Lord Chief Justice following the removal of the Lord Chancellor's judicial functions by the Constitutional Reform Act 2005 (c.4) ("the 2005 Act"). A separate Order, the Lord Chancellor (Transfer of Functions and Supplementary Provisions) (No. 2) Order 2006, makes similar amendments to provisions contained in primary legislation and in secondary legislation subject to approval by Parliament. Article 3 of, and Schedule 2 to, this Order make amendments supplemental to provision made by the 2005 Act.
