The Court of Appeal has granted permission to the Official Solicitor to challenge aspects of the order of Cohen J in the CDM case reported [https://www.39essex.com/cop_cases/rb-greenwich-v-cdm/ here], and has listed the case with commendable speed, to be heard on 6 November 2018, specifically to consider the approach to be taken to cases of fluctuating capacity.
