1.	Sections 9, 10, 17 [to 17C, 17E, 17F, 20A],<ref name="MHA">[[Mental Health Act 2007]] s55 & sch 11 by [[Mental Health Act 2007 (Commencement No. 6 and After-care under Supervision: Savings, Modifications and Transitional Provisions) Order 2008]]; s11, s32 & sch 3, s33, s37, s55 & sch 11 by [[Mental Health Act 2007 (Commencement No. 7 and Transitional Provisions) Order 2008]] wef 3/11/08</ref> [21 to 21B,]<ref name="PIC">[[Mental Health (Patients in the Community) Act 1995]]</ref> 24(3) and (4), [26]<ref name="MHA"/> to 28, 31, 32, 34, 67 and 76 shall apply in relation to the patient without modification.

1 . Sections 24(3) and (4), 32 and 76 shall apply in relation to the patient without modification.

2.	Sections [17, 18, 19],<ref name="MHA"/> 22, 23 and 34 shall apply in relation to the patient with the modifications specified in paragraphs 3 to 8 below.

3.	In section 17—

:(a)	in subsection (1) after the word "may" there shall be inserted the words "with the consent of the Secretary of State";

:[(aa)  subsections (2A) and (2B) shall be omitted;]<ref name="MHA"/>

:(b)	in subsection (4) after the words ["the responsible clinician" and after the words "that clinician"]<ref name="MHA"/> there shall be inserted the words "or the Secretary of State"; and

8.	In section 34, in subsection (1) the definition of "the nominated medical attendant" and subsection (3) shall be omitted.
