Dear LPS Stakeholders,
This is the latest edition of the LPS newsletter, which contains key updates on our progress to implement LPS.
LPS consultation goes live!
Today the Government has launched a public consultation on proposed changes to the Mental Capacity Act (MCA) Code of Practice for England and Wales, which includes guidance on the new LPS system. The consultation document and the Code of Practice will also be published in Welsh.
This is a joint consultation published by DHSC and MoJ. The consultation will run for 16 weeks from the 17 March until 7 July 2022.
Alongside the consultation, we have also published six sets of draft regulations which will underpin LPS – we are not required to consult on the regulations however we have decided to publish these to seek views on the policy detail of each set of regulations. When enacted, four of these sets of regulations would apply in England only. The remaining two sets of regulations would apply to both England and Wales. We have also published a number of documents that are intended to support the sector with LPS implementation.
