Calvert v Clydesdale Bank Plc [2012] EWCA Civ 962, [2012] MHLO 131
There is no requirement for a mortgagor to give consent or to be capable of giving consent at the time when the security is enforced. Accordingly, the bank were entitled to enforce their mortgage (by the appointment of receivers who sold the property) despite the mortgagor's lack of capacity.
